A YOUNG man who offered a teenage friend $10 to bash a defenceless overseas student who ran on to a major road in fright and was killed by a car should not have escaped a jail term, crime victim groups say.

Justice Stephen Kaye said he had given the exceptional case "anxious and careful consideration" before sentencing Aaron James Toal, now 19, to a maximum two-year community-based order with 500 hours of unpaid community work.

Despite court evidence that Toal was genuinely remorseful over the death of victim Yuxiong Han, he refused to apologise when approached at his front door. When asked if he wanted to say anything, he told the Herald Sun to "forget it" before retreating inside and slamming the door.

Toal, of Box Hill, had pleaded guilty in the Supreme Court to manslaughter over the death of Mr Han in July last year. Mr Han, 21, an auto engineering TAFE student, had been in Australia only 12 weeks when died. He was on his way home from his night job at a restaurant when Toal and his teenage friend ran from their group to attack him on a footpath.

After one of the group was heard to say "let's roll" or "let's hit" Mr Han, Toal offered his 15-year-old mate $10 to do it. As Toal and the teenager ran at Mr Han, Mr Han bolted in fright on to Canterbury Rd where he was struck by a car. "Both you and (your teenage friend) walked away quickly from the scene without pausing to render assistance to Mr Han, or to obtain help for him," Justice Kaye told Toal yesterday. Mr Han died in hospital 11 days later.

While Toal refused to express his regret on Monday night, The Supreme Court had earlier heard of his remorse. "When (the investigating police officer) rang me up on the night Mr Han died, Aaron cried and I said to him, 'What are you crying for'?" Toal's father, Brendan, said at his plea hearing last week. "He said, 'They'll never know their son.' It was gut-wrenching to say the least." Toal's aunt, Fiona Cornwall, said: "He agrees this is never going to leave him - that he has played a hand in this young man's death."

People Against Lenient Sentencing president Steve Medcraft said the court should have made an example of Toal to deter others from what Justice Kaye described as "gratuitous and cowardly" violence. Justice Kaye took into account mitigating factors including Toal's youth and guilty plea, remorse and the fact it was a dumb decision on the spur of the moment. Aggravating factors included the fact Mr Han was attacked in the dark from behind, with no chance to defend himself, Justice Kaye said.
