簡單總結:猶太人傳統上不承認養子的繼承權(有特例),領養不會改變被領養者的家譜關係和繼承權。換言之,被領養者只能繼承生父的遺產,只能被列在生父的宗譜上。

Judaism, historically, had strong ethical mandates regarding care of orphans, but no tradition regarding adoption. It is, in fact, spelled out in Jewish law that:
" despite the rulings of civil courts regarding adoption and the responsibility of the adoptive parent towards the adopted child, Jewish law declares unequivocally that nothing can break the family relationship between a child and the natural parents."
Jewish law furthermore maintains that despite any civil laws, a person trapped in an adoption "does inherit from his natural parents and relatives." And adoptive children do not inherit from those who reared them as do the later's natural children.
Taking care of orphans, therefore, in accordance to Jewish law, is identical with guardianships to the age of maturity which do not involve change of family identity or loss of inheritance rights. |
