這個美國律師為200美元折騰沒完
一個倒霉的美國離婚男,每月稅後收入的65%要付扶養費並且償還前妻的律師費。扣除就扣除吧,比如聖誕節時公司給每個員工$1000年終獎,除去稅後,再除去65%的「債務」,這男的拿到手只有$235.72。
哪想新年後,公司副總裁找這男的,說他前妻的猶太律師給公司來信,討要全部獎金,連這剩下的$235.72也不放過。什麼奇葩啊,這點錢也值得折騰?
這種事還真沒法請律師,不值,可是又不甘心被前妻律師要挾,所以只能來找我。我瀏覽一下副總裁轉發的那個猶太律師給公司的律師的電郵,羅列了幾個聯邦案例法,不外乎是說除日常工資外的其它收入必須%100還債,不再受%65還債額的限制。

Act』s limitation on the percentage of earnings that are subject to
garnishment.

我就奇怪,這一堆案例法怎麼就鬧到人家工作單位了,給誰看啊?公司職員有責任研究案例法為自己辯護嗎?這法庭上的事怎麼都下放到公司了?公司難道有權利做判決嗎?
去他媽的,你想要錢就上法庭折騰去,只要法官下令獎金還債那就沒說的。別把公說公有理婆說婆有理的案例法顯擺到公司里,公司不是法院,滾開!
當然,我為這僱員起草回信時還是滿客氣禮貌據理力爭的,而且提醒公司照章辦事,如果公司濫權,僱員可以狀告公司毀約。

It is the Court's authority to adopt a case law.
It is not the company's scope to make a decision based on case law.
It is not an employee's responsibility to make arguments to employer regarding case law.
It is not professional for an attorney to stir up case-law argument between an employee and employer.
The attorney should file a motion to get a court order if she wants to take an employee's bonus of $235.72 for Christmas.
We should follow the process in case anything results in a breach of contract.
