2010年1月至3月NIW申請批准案例分析

2010年1月到3月，我們事務所共有93件NIW申請獲得了批准，其中有66件未經過RFE程序
就直接獲得了批准。

在這三個月批准的93件申請中，大部分申請人都擁有博士學位。但是，也有12位申請人
只有碩士學位，約佔總人數的13%。而在這些碩士學位的申請人中，有3人從事石油天然
氣相關領域的工作；其中只有1位發表過文章以及參與文章審議工作，其餘兩位都沒有
這方面的經驗。這與一般申請的平均水平差很多。從本質上來講，這些信息反映了移民
局目前對該領域的申請人的要求有所放寬。出於政治以及安全原因的考慮，美國非常重
視石油及天然氣產業。此外，與醫療科學等熱門科學相比，該領域人才並沒有那麼飽和
，也就是說申請人的競爭相對比較小。而醫學和生物學等領域的申請要面對大量的申請
人間的競爭，而移民局也只能選擇最強有力的申請批准。通過我們的實踐發現，申請人
工作領域與美國社會當前需求的結合很大程度上決定了NIW申請的結果。

「博士后研究員」、「研究員/助理研究員」以及類似職位的申請人都主要從事研究工
作，發表文章以及參加會議等。因為科學研究工作本身的性質，這些申請人相比之下更
容易證明具有國家層次上的影響力，並且能夠通過更多的客觀證據證明曾經的成就（即
引用、下載、商業化等）。但是，如果缺少這類的證據也並不一定就阻礙申請。因為，
每個申請人的狀況都不同，移民局會根據每份申請的不同資格條件以及能否為美國帶來
價值來評定。就像上面所講，移民局不會僅僅憑藉數據來裁決申請。經驗豐富的律師能
夠幫助申請人在申請的準備中揚長避短。

除此之外，我們還注意到一些其他信息。大部分申請人都從事醫學，生物學及工程等相
關領域的研究工作，也有一些人從事計算機科學以及核物理的研究。他們平均發表的文
章數為9篇，審議文章數量為1次。申請平均的處理時間為183天，大約6個月，其中最長
的為910天，最短的只有15天。移民局處理NIW申請的目標時間為4個月；但目前全國NIW
申請處理時間平均達到了12.3個月。根據我們的經驗來看，經濟衰退之前NIW申請比現
在更容易獲得批准。而現在，因為美國就業機會的減少，移民局明顯提高了NIW申請的
處理標準。作為我們事務所專業技能的證明，我們的NIW申請的批準時間遠遠短於全國
的平均數據。

此外，從2010年1月到3月，我們事務所還獲得了65件EB-1申請的批准，其中包括：41件
EB-1(a)，21件EB-1(b)以及3件EB-1(c)申請；其中50件申請沒有經過RFE程序就獲得了

在文章的最後我們要再次強調，在開始一個申請程序之前，特別是在移民局提高了NIW
申請的處理標準之後，申請人最好要先向經驗豐富的律師進行諮詢。律師會幫助申請人
