KNOWING YOUR RIGHTS WHEN STOPPED OR
DETAINED BY IMMIGRATION AGENTS
1.
Avoid local immigration checkpoints (Check list and
map). But if you happen to come across a border checkpoint and stopped, see
below.
2.
If you wish to remain silent, tell the agent.
3.
Stay calm and do not run away.
4.
You do not have to consent to a search of yourself or
your car if you are stopped in your car.
5.
When stopped in a car, upon request, show the immigration
agent your driver』s license, registration, and proof of insurance.
6.
You have the right to remain silent when asked about
your immigration status. You do not have to answer questions about whether you
are a U.S. citizen, or the method of which you entered the country. (Separate
rules apply at international borders and airports and if you are a tourist or
business traveler.)
7.
If you are not a U.S. citizen and have valid
immigration papers, you should show it to the immigration agent if requested.
8.
Never lie about your citizenship status or provide
false documents to the agent.
9.
When immigration agents take you into custody, you
have a right to remain silent, a right to an attorney, but the government does
not have to provide you with one.
10.
Never sign any document without talking to a lawyer.
11.
Write down everything you remember including the agent』s
badge number, any witness information you can get, and take pictures of any
injuries you might have sustained that requires medical attention.
